BIR files seven tax evasion cases
THE BUREAU OF INTERNAL Revenue (BIR) yesterday filed seven criminal complaints against traders and companies suspected of dodging taxes due to the government with a combined liability of P389.59 million.
In a press release, the BIR said DG Cold Chain, Inc., a distributor of Nestlé products, was sued for underdeclaring its tax liabilities for 2006.
Based on the BIR’s cross-checking of the distributor’s and Nestlé Philippines, Inc.’s tax declarations, the latter’s total sales to DG Cold Chain reached P133.56 million but the trading company only declared a gross receipt amounting to P14.17 million, an underdeclaration of 842.49% or P119.39 million.
Undeclared sales, based on the computation of BIR’s investigators, were computed at P138.07 million.
Corporate officers Gregorio M. Mendoza (President) and Larry H. Rodriguez (Treasurer) were also included in the complaint.
R-Jell Marketing & Construction Company, together with general partners Lily R. Pedroso, Ernesto O. Pedroso and Elvin Louie Pedroso, was also sued for underdeclaring its tax payments from 2005 to 2008 after comparing its declared gross sales to its actual sales to one of its clients.
R-Jell was sued for an aggregate tax liability amounting to P73.8 million, inclusive of charges and interest for the four-year period.
On the other hand, three firms and two individuals were sued for tax evasion after failing to pay the correct taxes despite BIR’s repeated demands.
Sherri Anne B. Orbeta, a dry goods wholesaler, has been assessed with a deficiency tax liability of P61.76 million for 2007, inclusive of increments, which includes P26.83 million in income taxes (IT) and P34.93 million in value-added taxes (VAT).
Nympha T. Lacdao, owner of Banawe Paint Center & General Merchandize, has a computed tax deficiency for 2007 amounting to P10.7 million: P6 million in income taxes and P4.7 million in VAT.
Buildtosuit Corp., a construction company, was likewise sued for deficiency tax liabilities for 2005 which reached P12.97 million: P9.87 million in income taxes and P3.10 million in VAT.
Buildtosuit’s corporate officers, President Arnold C. Guiao and Treasurer Marilou A. Guiao, were included in the complaint.
E&D Parts Supply, Inc. was assessed with a P30.03 million liability, which includes P22.14 million in income taxes and P7.89 million in VAT. Its Chairman, Cipriano C. Uy and Treasurer Margaret L. Uy were included in the complaint.
Haldane Philippines, its Chairman Hua Cuen Uychiong and Chief Finance officer Cherry Uyco-Ong were sued for a deficiency VAT liability of P8.92 million for 2007. — Mikhail Franz E. Flores
